PRODUCT LIMITED WARRANTY AND LIMITATIONS OF LIABILITY
Sun Hydraulics warrants that its products will, under normal use and operation
as specified in the manufacturer’s literature, be free from defects in
material, workmanship, and design for a period of three years from and after
their installation date, provided their installation date is less than one year
after their manufacture date. “O-rings” and seals are specifically exempted
from this warranty. Sun Hydraulics’ liability under this warranty shall extend
only to repair or replacement, f.o.b. Sun Hydraulics’ factory, of any product
determined by Sun Hydraulics’ inspection to be defective and warranted. Sun
Hydraulics disclaims any and all other warranties, conditions, and
representations (whether statutory, express, or implied, oral or written) with
respect to its products, including, but not limited to, any and all implied
warranties or conditions of fitness or suitability for any particular purpose
(whether or not Sun Hydraulics knows, has reason to know, has been advised, or
is otherwise in fact aware of any such purpose), whether alleged to arise by
law, course of dealing, course of performance, or custom or usage of trade. Sun
Hydraulics cannot and does not accept responsibility for or warrant any of its
products that have been subjected to improper installation, improper
application, negligence, tampering, misuse, abuse, damage, or which have been
repaired, altered, or modified outside of Sun Hydraulics’ factory. In no event
shall Sun Hydraulics be liable to any buyer or end user of any of its products
for any incidental, consequential (including, but not limited to, lost profits,
business, or other pecuniary loss), indirect, punitive, or special damages
arising out of or in any manner incident, relating, pertaining, or attributable
to its products, Sun Hydraulics’ liability being limited to the value of the
product sold or an obligation to repair or replace a defective product.
